Terms of Service
1. Validity and definition of terms
These General Terms and Conditions (hereinafter referred to as GTC) apply in the currently valid legal version to all services provided by ISG Personnel Management Ltd. (hereinafter referred to as ISG) in the context of job offers for potential and qualified candidates.
By submitting their personal application documents, the candidate agrees to these GTC.
The provisions of these GTCs remain invariably effective, wether or not individual provisions be invalid in whole or in part due to mandatory legal regulations.
ISG can change or supplement these General Terms and Conditions at any time, without prior notice. Changes and additions will be published on the websites http://www.isg.com and https://www.isg.com/jobs.
ISG will exclusively work on behalf of its clients, never on behalf of candidates. ISG therefore points out that no contract and no binding agreements are concluded between ISG and candidates in the context of the processing of job offers.
2. Definition of terms
Potential and qualified candidates are referred to as “candidates” – these GTC refer to any natural person who is contacted by ISG in the context of job offers from clients, who is actively approached for future occupations or who contacts ISG in order to be considered for future job offers.
“Clients” according to this GTC are companies who are looking for candidates to fill open positions and have commissioned ISG with the search and selection of such persons.
“Job offers” are orders of clients to find suitable candidates for open positions.
These GTC do not constitute a contract or binding agreement between ISG and candidates who provide us with personal information and data.
3. Storage and processing of information and data
We store personal data in our database in accordance with the respective data protection regulations in the current version of GDPR (EU).
This database is used by our employees and contracting partners, bound by our contractual agreements, for the search and selection of candidates and for related services for clients and candidates.
ISG regularly informs candidates via e-mail about additional services closely related to their career development. Candidates my unsubscribe from such information by the transmission of an e-mail.
To store personal data, ISG exclusively uses service providers who guarantee data storage on servers within Austria. Candidates’ data will be stored according to the applicable laws.
ISG does not collect, processes or store sensitive information concerning ethnic origin, sexual or political orientation, religious or philosophical views or affiliation to political associations, such as trade unions.
4. Transfer of data
Generally, the personal data of candidates (including personal documents such as a CV, certificates of education, testimonials, letters of recommendation, etc.) are not passed on to third parties by ISG.
The necessary transmission of personal data to clients in the context of current job offers, and to partners entrusted with the execution of aptitude tests is excluded. This will happen exclusively with the candidate’s consent.
After a verbal or written consent to the release of data, our clients are informed about the confidentiality of the provided documentats and are obliged to provide for the corresponding protection of data privacy by signing a processing agreement with ISG. The candidate’s consent is exclusively obtained for individual job offers.
5. Receipt of personal data
ISG accepts the transmission of candidates’ personal data exclusively via uploads on the website www.isg.com/jobs and via e-mail. ISG does not accept postal applications.
6. Information about stored personal data and deletion of data
Based on the respective underlying legal regulations, candidates may request information about their personal data being stored with ISG. They can request that their personal data be deleted from our database at any time. Additionally, candidates can choose not to be contacted by ISG.
7. Data security
All data is securely stored on servers in an external data center in Vienna, which specializes in hardware and data protection.
As far as ISG can reasonably be expected and is legally required to do so, it obliges all employees and service providers with whom it cooperates in the storing and processing of candidates’ personal data, to take the appropriate organizational and technical measures to protect personal data from loss, accidental or unauthorized deletion, modification, misuse, publication and other illegal processing and distribution.
8. Confidentiality
ISG obliges to maintain confidentiality in regards to internal affairs and information provided by its clients. Only information explicitly authorized by the client will be passed on to candidates. In particular, ISG will only name its client to candidates under the conditions and at the times determined by the client.
ISG commits to confidentiality towards all candidates and only seeks references from testimonials they have announced when they have expressly agreed to it. ISG will not communicate information concerning the applications of candidates with parties not associated to the company.
When a candidate has given his consent to the transmission of their application documents to a client, ISG expressly informs the client that they and all their employees are obliged to strict confidentiality regarding the application.
ISG employees and third parties who actively participate in an application process are obliged to complete discretion during and after the conclusion of process.
The regulations of the data protection laws are strictly adhered to by ISG. ISG ensures that unauthorized persons will not have access to internal documents or information concerning the process before, during and after the completion of the order.
9. Non-discrimination
ISG strictly adheres to the regulations of the GlBG (Austria) and the AGG (Germany).
Candidate profiles transmitted to clients do not contain information that could constitute a basis for discrimination in accordance with GlBG or AGG, with the exception of gender and date of birth. ISG expressly points out to all its clients that gender and age must not lead to any form of discrimination.
10. Accuracy of information and data transmitted
ISG, to the best of its knowledge, only passes on correct information and client data to candidates. ISG is however not obliged to verify the accuracy of information and data provided by its clients.
Candidates who enter an application process commit themselves to provide truthful information about their professional background. The authenticity of transmitted documents and the accuracy of information provided must expressly be confirmed by the candidate. The candidate agrees that this information can be verified by ISG.
11. Remuneration for our services
Since ISG, in the context of job offers, acts for its clients and exclusively on the basis of this contractual relationship, the services provided within this scope are always free of charge for candidates.
Additional services for candidates (e.g. coaching, career consulting, training etc.) may be charged seperately. In any case, ISG will expressly inform in advance about additional costs for services offered. For such services, the conclusion of a separate contract or agreement will be required.
12. Social graces and ethics
When contacting candidates, ISG commits itself to good manners, politeness and professional behavior, and expects the same from candidates. ISG reserves the right to break off contact with candidates who do not meet the required level of manners and professionalism.
Among other things, ISG understands professionalism of candidates to be the following:
- The appropriate cooperation in the gathering of information and in profile creation
- An appropriate degree of flexibility, especially regarding the temporal availability for interviews
- Open and timely communication when candidates are simultaneously involved in other application processes
- Immediate and open communication when candidates are not interested in a job offer
13. Final Clause
This contract is established under Austrian Law to the exclusion of the UN Sales Convention and conflict-of-law rules. The place of jurisdiction is Vienna, Austria. The invalidity of individual provisions of these GTC will not affect the validity of the remaining provisions.
